{"id":4042,"date":"2025-07-22T16:32:06","date_gmt":"2025-07-22T11:02:06","guid":{"rendered":"https:\/\/ambcolombo.esteri.it\/?page_id=4042"},"modified":"2026-09-09T15:55:46","modified_gmt":"2026-09-09T10:25:46","slug":"registration-of-a-minors-birth-certificate-2","status":"publish","type":"page","link":"https:\/\/ambcolombo.esteri.it\/en\/servizi-consolari-e-visti\/servizi-per-il-cittadino-italiano\/stato-civile\/registration-of-a-minors-birth-certificate-2\/","title":{"rendered":"Registration of a Minor\u2019s Birth Certificate"},"content":{"rendered":"<p style=\"text-align: justify;\" data-pm-slice=\"1 1 []\">Law No. 74 of 23 May 2025, which converted Decree-Law No. 36 of 28 March 2025 into law with amendments, reformed <a href=\"https:\/\/www.normattiva.it\/uri-res\/N2Ls?urn:nir:stato:legge:1992-02-05;91!vig=\">Law No. 91 of 5 February 1992<\/a>, introducing significant restrictions on the transmission of Italian citizenship and, consequently, also on the procedure for the registration of the birth certificates of minors born abroad.<\/p>\n<p style=\"text-align: justify;\">Under the legislation currently in force, <strong>a minor born abroad to a parent who is an Italian citizen <span style=\"text-decoration: underline;\">is not automatically an Italian citizen<\/span>.<\/strong> Pursuant to the new legislation, the minor <strong>is recognised as an Italian citizen<\/strong> <em>iure sanguinis<\/em> (from birth) only if <strong>at least one of the following circumstances<\/strong> applies:<\/p>\n<p style=\"text-align: justify;\"><strong>CASE A)<\/strong><\/p>\n<p style=\"text-align: justify;\"><strong>A1)<\/strong> <span style=\"text-decoration: underline;\">The parent who was born an Italian citizen, even if also holding another citizenship, resided in Italy for at least two consecutive years at any time before the date of birth of the child<\/span>;<\/p>\n<p style=\"text-align: justify;\">or<\/p>\n<p style=\"text-align: justify;\"><strong>A2)<\/strong> <span style=\"text-decoration: underline;\">The parent acquired Italian citizenship through naturalisation and resided in Italy for at least two consecutive years after acquiring Italian citizenship and before the date of birth of the child<\/span>.<\/p>\n<p style=\"text-align: justify;\">Any period of residence in Italy before the acquisition of Italian citizenship, as well as any period of residence in Italy by the foreign parent, is not relevant.<\/p>\n<p style=\"text-align: justify;\">In these cases, <strong>the following documents<\/strong> must be submitted <strong>to request the registration of the birth certificate in Italy<\/strong>:<\/p>\n<ol style=\"text-align: justify;\" start=\"1\" data-spread=\"false\">\n<li><a href=\"https:\/\/ambcolombo.esteri.it\/wp-content\/uploads\/2025\/07\/Richiesta-trascrizione-atto-di-nascita-minore-07.2025.pdf\">application for the registration of the birth certificate<\/a>;<\/li>\n<li>the minor\u2019s birth certificate, or an extract thereof, issued by the competent foreign Civil Registry Office. The certificate must be submitted to the Embassy after having been legalised by the Ministry of Foreign Affairs of Sri Lanka or the Maldives (for further information, please consult the <a href=\"https:\/\/ambcolombo.esteri.it\/en\/servizi-consolari-e-visti\/servizi-per-il-cittadino-italiano\/traduzione-e-legalizzazione-dei-documenti\/\">Translations and legalisations<\/a> section of this website);<\/li>\n<li>photocopies of the passports or valid identity documents of the parents and the minor (if the minor already holds one);<\/li>\n<li>a citizenship certificate for the Italian parent, issued on plain paper for citizenship purposes (exempt from stamp duty), specifying the place, date and manner in which Italian citizenship was acquired, and issued by the competent Italian municipality;<\/li>\n<li>historical residence certificates, issued on plain paper for citizenship purposes (exempt from stamp duty), by all Italian municipalities in which the Italian parent resided after acquiring Italian citizenship.<\/li>\n<\/ol>\n<p style=\"text-align: justify;\"><strong>PLEASE NOTE: If the circumstances under A1) or A2) apply, it will not be necessary to comply with the requirements under cases B) or C), which require additional documentation.<\/strong><\/p>\n<p style=\"text-align: justify;\"><strong>CASE B)<\/strong><\/p>\n<p style=\"text-align: justify;\"><strong>B1)<\/strong> <span style=\"text-decoration: underline;\">On the date of the minor\u2019s birth, one parent held Italian citizenship exclusively<\/span>.<\/p>\n<p style=\"text-align: justify;\">In this case, <strong>the following documents<\/strong> must be submitted <strong>to request the registration of the birth certificate in Italy<\/strong>:<\/p>\n<ol style=\"text-align: justify;\" start=\"1\" data-spread=\"false\">\n<li><a href=\"https:\/\/ambcolombo.esteri.it\/wp-content\/uploads\/2025\/07\/Richiesta-trascrizione-atto-di-nascita-minore-07.2025.pdf\">application for the registration of the birth certificate<\/a>;<\/li>\n<li>the minor\u2019s birth certificate, or an extract thereof, issued by the competent foreign Civil Registry Office. The certificate must be submitted to the Embassy after having been legalised by the Ministry of Foreign Affairs of Sri Lanka or the Maldives (for further information, please consult the <a href=\"https:\/\/ambcolombo.esteri.it\/en\/servizi-consolari-e-visti\/servizi-per-il-cittadino-italiano\/traduzione-e-legalizzazione-dei-documenti\/\">Translations and legalisations<\/a> section of this website);<\/li>\n<li>photocopies of the passports or valid identity documents of the parents and the minor (if the minor already holds one);<\/li>\n<li>a full copy of the Italian parent\u2019s birth certificate, issued by the Italian municipality of birth;<\/li>\n<li>a historical residence certificate issued by the Italian municipalities in which the parent resided;<\/li>\n<li>a certificate issued by the competent authorities of the foreign country of emigration, duly legalised\/apostilled and accompanied by an official translation into Italian (in this regard, the competent Italian Consular Office for the place in which the documents were issued must be contacted), certifying that the Italian parent did not acquire the citizenship of the foreign country of emigration before the minor\u2019s birth.<\/li>\n<\/ol>\n<p style=\"text-align: justify;\">or<\/p>\n<p style=\"text-align: justify;\"><strong>B2)<\/strong> <span style=\"text-decoration: underline;\">On the date of the minor\u2019s birth, one grandparent held Italian citizenship exclusively. PLEASE NOTE: Where a grandparent held Italian citizenship exclusively, the minor\u2019s parent must nevertheless hold Italian citizenship, even if not exclusively<\/span>.<\/p>\n<p style=\"text-align: justify;\">In this case, <strong>the following documents<\/strong> must be submitted <strong>to request the registration of the birth certificate in Italy<\/strong>:<\/p>\n<ol style=\"text-align: justify;\" start=\"1\" data-spread=\"false\">\n<li><a href=\"https:\/\/ambcolombo.esteri.it\/wp-content\/uploads\/2025\/07\/Richiesta-trascrizione-atto-di-nascita-minore-07.2025.pdf\">application for the registration of the birth certificate<\/a>;<\/li>\n<li>the minor\u2019s birth certificate, or an extract thereof, issued by the competent foreign Civil Registry Office. The certificate must be submitted to the Embassy after having been legalised by the Ministry of Foreign Affairs of Sri Lanka or the Maldives (for further information, please consult the <a href=\"https:\/\/ambcolombo.esteri.it\/en\/servizi-consolari-e-visti\/servizi-per-il-cittadino-italiano\/traduzione-e-legalizzazione-dei-documenti\/\">Translations and legalisations<\/a> section of this website);<\/li>\n<li>photocopies of the passports or valid identity documents of the parents and the minor (if the minor already holds one);<\/li>\n<li>a full copy of the parent\u2019s birth certificate, issued by the Italian municipality of birth;<\/li>\n<li>a full copy of the grandparent\u2019s birth certificate, issued by the Italian municipality of birth;<\/li>\n<li>a historical residence certificate issued by the Italian municipalities in which the grandparent resided;<\/li>\n<li>(if the grandparent lived in a foreign country) a certificate issued by the competent authorities of the foreign country of emigration, apostilled or legalised by a consular authority (for countries that have not signed the 1961 Hague Convention) and duly accompanied by an official translation into Italian (in this regard, the competent Italian Consular Office for the place in which the documents were issued must be contacted), certifying that the Italian grandparent did not acquire the citizenship of the foreign country of emigration before the minor\u2019s birth;<\/li>\n<li>any certificates attesting to the renunciation of citizenship;<\/li>\n<li>any other documentation capable of proving that the person is not a citizen of the foreign country.<\/li>\n<\/ol>\n<p style=\"text-align: justify;\"><strong>CASE C)<\/strong><\/p>\n<p style=\"text-align: justify;\"><span style=\"text-decoration: underline;\">The minor neither holds nor is able to acquire another citizenship (for example, <em>iure sanguinis<\/em>, <em>iure soli<\/em>, citizenship by option, etc.)<\/span>.<\/p>\n<p style=\"text-align: justify;\">A minor is deemed, for example, to hold another citizenship if he or she:<\/p>\n<ul style=\"text-align: justify;\" data-spread=\"false\">\n<li>acquires it <em>iure sanguinis<\/em> from either parent;<\/li>\n<li>acquires it <em>iure soli<\/em> (e.g. by being born in a country that applies this principle);<\/li>\n<li>acquires it through a simple declaration, without the foreign authorities having the power to refuse it (for example, through \u201ccitizenship by option\u201d to be exercised for children born abroad). IMPORTANT: even if the parents decide not to make the declaration of option, the minor is nevertheless deemed to hold another citizenship.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">In this case, <strong>the following documents<\/strong> must be submitted <strong>to request the registration of the birth certificate in Italy<\/strong>:<\/p>\n<ol style=\"text-align: justify;\" start=\"1\" data-spread=\"false\">\n<li><a href=\"https:\/\/ambcolombo.esteri.it\/wp-content\/uploads\/2025\/07\/Richiesta-trascrizione-atto-di-nascita-minore-07.2025.pdf\">application for the registration of the birth certificate<\/a>;<\/li>\n<li>the minor\u2019s birth certificate, or an extract thereof, issued by the competent foreign Civil Registry Office. The certificate must be submitted to the Embassy after having been legalised by the Ministry of Foreign Affairs of Sri Lanka or the Maldives (for further information, please consult the <a href=\"https:\/\/ambcolombo.esteri.it\/en\/servizi-consolari-e-visti\/servizi-per-il-cittadino-italiano\/traduzione-e-legalizzazione-dei-documenti\/\">Translations and legalisations<\/a> section of this website);<\/li>\n<li>photocopies of the passports or valid identity documents of the parents and the minor (if the minor already holds one);<\/li>\n<li>a historical residence certificate issued by the Italian municipalities in which the Italian parent resided (or both parents, if both are Italian);<\/li>\n<li>(only if the Historical Residence Certificate records periods of residence abroad) a declaration of non-naturalisation, apostilled or legalised by a consular authority (for countries that have not signed the 1961 Hague Convention), duly accompanied by an official translation into Italian (in this regard, the competent Italian Consular Office for the place in which the documents were issued must be contacted), issued by the authorities of all countries in which the Italian parents resided;<\/li>\n<li>(if either parent was born in a foreign country or holds another citizenship or multiple other citizenships) the original certificate attesting that citizenship was not transmitted to the minor, legalised and translated into Italian (in this regard, the competent Italian Consular Office for the place in which the documents were issued must be contacted), issued by the authorities of the parent\u2019s country of birth and\/or by those of the country or countries whose citizenship the parent holds;<\/li>\n<li>any certificate of statelessness issued by the competent foreign authorities of the minor\u2019s country of birth, in the original, legalised and translated into Italian (in this regard, the competent Italian Consular Office for the place in which the documents were issued must be contacted).<\/li>\n<\/ol>\n<p style=\"text-align: justify;\"><span style=\"text-decoration: underline;\"><strong>PROCEDURE FOR REQUESTING THE REGISTRATION OF A MINOR\u2019S BIRTH CERTIFICATE<\/strong><\/span><\/p>\n<p style=\"text-align: justify;\">The original documentation must be submitted directly to the Embassy after booking an appointment through the <a href=\"https:\/\/prenotami.esteri.it\" data-rich-text-autolink=\"\">https:\/\/prenotami.esteri.it<\/a> portal.<\/p>\n<p style=\"text-align: justify;\">The legalisation and authentication of the Italian translation will be carried out directly by the Embassy. The certificate to be registered must therefore be submitted together with the certification issued by the Ministry of Foreign Affairs of Sri Lanka.<\/p>\n<p style=\"text-align: justify;\">As the authenticity of certificates issued in Sri Lanka and submitted to the Embassy may be verified by the International Organization for Migration (IOM), as explained in the <a href=\"https:\/\/ambcolombo.esteri.it\/en\/servizi-consolari-e-visti\/servizi-per-il-cittadino-italiano\/traduzione-e-legalizzazione-dei-documenti\/\">Translations and legalisations<\/a> section of this website, the certificates will be forwarded to the competent municipality only after these checks have been completed.<\/p>\n<p style=\"text-align: justify;\"><strong>FORMS<\/strong><\/p>\n<p style=\"text-align: justify;\"><a href=\"https:\/\/ambcolombo.esteri.it\/wp-content\/uploads\/2025\/07\/Richiesta-trascrizione-atto-di-nascita-minore-07.2025.pdf\">Application for the registration of the birth certificate<\/a>;<\/p>\n","protected":false},"excerpt":{"rendered":"Law No. 74 of 23 May 2025, which converted Decree-Law No. 36 of 28 March 2025 into law with amendments, reformed Law No. 91 of 5 February 1992, introducing significant restrictions on the transmission of Italian citizenship and, consequently, also on the procedure for the registration of the birth certificates of minors born abroad.
